Welcome to Healthy Hustle (the "App"). These Terms of Service ("Terms") govern your access to and use of the App, including all features, content, and services provided therein. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Account Registration and Use
Eligibility: You must be at least 16 years old to create an account and use the App. By creating an account, you represent and warrant that you meet this age requirement.
Account Information: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary to keep it accurate, current, and complete.
Account Security: You agree to notify us immediately of any unauthorized access to or use of your account. We will not be liable for any loss or damage arising from your failure to comply with this section.
Account Suspension or Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to your violation of these Terms.
3. Use of the App
License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial fitness purposes.
Prohibited Conduct: You agree not to:
• Use the App for any illegal or unauthorized purpose.
• Modify, adapt, hack, or reverse engineer any part of the App.
• Interfere with or disrupt the operation of the App or the servers and networks connected to the App.
• Use any robot, spider, scraper, or other automated means to access the App for any purpose without our express written permission.
• Transmit any viruses, worms, or other malicious code.
• Impersonate any other person or entity or misrepresent your affiliation with any person or entity.
• Collect or harvest any personally identifiable information from other users without their consent.
• Use the App in a way that violates the rights of any third party, including intellectual property rights.
• Circumvent any security or technological measures implemented by us to protect the App or its users.
4. 3D Body Scans, AI, and AR Features
3D Body Scan Data: By using the 3D body scan feature, you consent to the collection and processing of your body scan data as described in our Privacy Policy. You understand that the accuracy of the 3D model and related analytics depends on various factors, and we do not guarantee perfect accuracy.
AI-Powered Features: The App utilizes artificial intelligence to provide personalized insights, workout recommendations, and progress tracking. You acknowledge that these are suggestions based on algorithms and data analysis and should not be considered medical advice.
AR Exercise Demonstrations: Our augmented reality exercise demonstrations are intended for guidance only. You are responsible for ensuring that you perform exercises safely and in a suitable environment free of obstacles. We are not liable for any injuries resulting from your use of the AR features.
5. Intellectual Property
Our Content: The App and its original content, including but not limited to text, graphics, images, software, logos, and the design and functionality of the App, are owned by or licensed to Healthy Hustle and are protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of any content you submit, post, or display on or through the App ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, distribute, modify, adapt, publicly display, and publicly perform Your Content in connection with the App and our business, including for the purposes of operating, promoting, and improving the App. You represent and warrant that you have all necessary rights to grant us this license.
6. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY RELIANCE ON THE INFORMATION PROVIDED THROUGH THE APP IS AT YOUR OWN RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEALTHY HUSTLE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING OR USING THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
8. Indemnification
You agree to indemnify, defend, and hold harmless Healthy Hustle and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your use of the App, Your Content, or your violation of any rights of a third party.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be exclusively resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of such courts.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our App and updating the "Last Updated" date at the top of this policy. We encourage you to review these Terms periodically for any changes. Your continued use of the App after the posting of a revised Terms constitutes your acceptance of the changes.
11. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Healthy Hustle regarding your access to and use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written.
